CFEG Student and Crew Filming — Media Release & Waiver of Liability

Production: Blue Tarp Productions, LLC ("BTP") for Center for Educational Growth, Inc. ("CFEG") — Film Over Gun Violence Program ("FOGV"). Governing law: U.S. Virgin Islands.
I am the parent or legal guardian of the student named in this form (the "Student") and have full legal authority to sign this Media Release and Waiver of Liability (this "Agreement") on the Student's behalf and in my own capacity. In consideration of the Student being permitted to take part in the filming activity described above (the "Activity"), I agree to the following.
Released Parties. "Released Parties" means CFEG, BTP, and any Production Company named above, and the FOGV program; the film crew, cast, and all production personnel; the owners, operators, and lessors of the filming location; CFEG's and BTP's program partners, sponsors, financiers, licensees, distributors, and exhibitors; and each of their respective parents, subsidiaries, affiliates, officers, directors, employees, agents, contractors, volunteers, successors, and assigns.
PART A — MEDIA RELEASE
A1 Grant of rights. I irrevocably grant the Released Parties the perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right and permission to record, photograph, film, and capture the Student's image, likeness, voice, name, statements, biographical information, and performance during the Activity, and to use, reproduce, edit, adapt, publish, distribute, broadcast, stream, display, and otherwise exploit the same and any resulting film, photographs, audio, or digital media (the "Media").
A2 All media, platforms, and purposes. The Media may be used in any and all media and formats now known or later developed — film, television, streaming, video-on-demand, internet, social media, mobile, print, and archival — worldwide and in perpetuity, for educational, promotional, marketing, publicity, festival, fundraising, journalistic, commercial, and non-commercial purposes.
A3 Allocation of rights. As between the Released Parties, CFEG retains control over educational, instructional, accreditation, grant, and archival uses, and BTP/the Production Company retains commercial, distribution, and exploitation rights, each consistent with the parties' production arrangements. The Released Parties may assign or sublicense these rights to distributors, platforms, broadcasters, and sales agents without further notice, approval, or compensation.
A4 No compensation; no approval. No royalty, fee, or other compensation is or will be payable for any authorized use of the Media. I waive any right to inspect or approve the Media or any use of it.
A5 Release of media claims. To the fullest extent permitted by law, I release the Released Parties from any and all claims arising out of the authorized capture and use of the Media, including claims for invasion of privacy, right of publicity, defamation, false light, copyright infringement, or misappropriation. The Released Parties will not knowingly use the Media in a defamatory manner or to state a false endorsement.
A6 Third-party distribution; ownership. Once Media is posted to social media, streaming, or other public forums, it may be shared or used by third parties beyond the Released Parties' control, for which they are not responsible. All Media is owned by CFEG and/or BTP as between the Released Parties and the Student, and the Student retains no ownership interest.
PART B — WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION
B1 Assumption of risk. I understand the Activity is an outdoor, evening, on-location film production that involves inherent and other risks, including: low light and darkness; uneven ground, terrain, water, weather, insects, and other natural or location hazards; vehicle and pedestrian traffic; use of and contact with cameras, lighting, rigging, cables, generators, electrical power, props, and other equipment; movement of cast, crew, and equipment; heat, dehydration, and fatigue; travel to and from the location; interaction with other participants and the public; and other production activities. I knowingly and voluntarily accept and assume ALL such risks — known or unknown, and whether or not arising from the ordinary negligence of the Released Parties — of injury, illness, disability, death, and property damage to the Student and to me.
B2 Release and covenant not to sue. To the fullest extent permitted by U.S. Virgin Islands law, I release, waive, and discharge the Released Parties from, and covenant not to sue them for, any and all claims, demands, liabilities, damages, costs, and causes of action of any kind — in law or equity, known or unknown — arising out of or related to the Student's participation in the Activity, including claims arising from the ordinary negligence of any Released Party. I make this release on behalf of the Student, myself, and our respective heirs, representatives, and estates.
B3 Limitation. This release does not apply to gross negligence, recklessness, or willful or intentional misconduct, or to any liability that U.S. Virgin Islands law does not permit to be released. Nothing here waives any right that cannot be waived by law.
B4 Indemnification. To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Student's participation in the Activity, the Student's or my acts or omissions, or my breach of this Agreement, including any claim brought by or on behalf of the Student.
B5 Insurance. I am responsible for the Student's and my own health, accident, and property insurance. The Released Parties do not provide insurance coverage for the Student unless expressly stated in writing.
PART C — ON-SITE SAFETY, SUPERVISION, AND CONDUCT
C1 Safety compliance. The Student will follow all instructions of the crew, assistant director, safety personnel, and CFEG staff; remain in designated areas; wear any required high-visibility or protective gear during evening filming; not touch cameras, lighting, rigging, generators, vehicles, or equipment unless directed; and not leave the set without an authorized release.
C2 Supervision, transportation, and authorized pickup. Filming occurs in the evening and may run late. The Student will be released only to a parent/guardian or an adult listed as an authorized pickup. Unless CFEG provides transportation in writing, I am responsible for the Student's transportation to and from the location. I authorize CFEG/BTP to follow reasonable check-in, head-count, and reunification procedures.
C3 Conduct. The Student will act respectfully and comply with the CFEG Code of Conduct and policies; will not possess weapons, illegal drugs, alcohol, or prohibited items; and may be removed from the Activity, without refund, for conduct that endangers or disrupts others.
C4 Health, property, and weather. The Student is physically and mentally able to take part, and I have disclosed any relevant condition. The Student's personal devices and property are the Student's responsibility and are brought at the Student's own risk. Severe weather, hurricane conditions, or safety concerns may delay, relocate, or cancel the Activity; the Released Parties are not liable for any resulting cost or loss.
PART D — MEDICAL AUTHORIZATION AND EMERGENCY CARE
D1 Authorization. If the Student is injured or needs medical attention during the Activity and I cannot be reached, I authorize the Released Parties to arrange emergency medical care and transportation. I am responsible for all related costs, and I release the Released Parties from claims arising from securing such care, to the extent permitted by law.
PART E — GENERAL
E1 Governing law and venue. This Agreement is governed by the laws of the U.S. Virgin Islands, and any dispute will be brought exclusively in the courts located in St. Croix, U.S. Virgin Islands. It is intended to be as broad and inclusive as U.S. Virgin Islands law permits; if any part is held unenforceable, the rest remains in force and the unenforceable part will be limited or modified to the least extent necessary.
E2 Relationship to CFEG policies. This is a program-specific consent under the CFEG Participant Terms & Conditions and the CFEG Institutional Policy Manual & Forms (MED-001, SAFE-001, SAFE-002, TRIP-001, and MEDICAL-001) and supplements, and does not replace, those documents.
E3 Electronic signature. I agree that electronic acceptance — including clicking "I AGREE," typing my name, or signing on CFEG's online page — is legally binding and has the same effect as a handwritten signature under the E-SIGN Act, UETA, and applicable U.S. Virgin Islands law, and may be captured with my typed name, the date, my IP address, and a time stamp.
